Terms and Conditions

1.1 upskill.study and the participant are the sole parties to the contract for the provision of the placement services into a study abroad program at Udayana University.

1.2 If the participant is demanding other services which are not part of the study program of upskill.study as insurances, vehicle rentals, accommodation, flights, visa etc. the contract is between the selected service provider and the participant only.

1.3 The participant herewith agrees that the partner organization is according to §4 the actual contractual partner for all services provided within the study program itself.

1.4 The participant must have reached the age of 18 by the beginning of the study program abroad.

By clicking on the box besides the phrase ‘I have read and agree to the upskill.study terms and conditions’ the participant agrees to these terms and conditions. The contract is valid after we have received and confirmed your registration fee. upskill.study cannot fully guarantee that the participant will be placed in the study program as stated in the application.

The main subjects of this contract are the placement into a study abroad program and the current service package of upskill.study at the contracting time. The placement service package can be looked up at the web presence. The services offered may vary according to the countries or specific demands of the participant.

4.1 The service can be looked up at www.upskill.study. However, upskill.study cannot guarantee that the information online is up to date. The current course and services of the Udayana University apply. upskill.study, Udayana University and its partner organizations are not liable for unindebted shifts in program dates.

4.2 upskilll.study places participants into study programs at Udayana University. Thus, upskill.study is only responsible for the placement service itself, but not for the services performed by Udayana University.

4.3 All study program offers are based on the information of the Udayana University and program coordinator. upskill.study is not liable for this information.

4.4 upskill.study has no influence on any factors that may cause a change of program presented on this website. Participants who agree to study abroad and accept the responsibilities and risks that are associated with their travel and stay abroad in the host country in Indonesia.

4.5 The registration fee of upskill.study is not refundable after registration.

upskill.study will start its services after the participant was successfully submitted online and the receipt of the registration fee from the participant has been confirmed to the participant.

6.1 The study program confirmation is a separate document between the participant and the Udayana University.

6.2 The signed study program confirmation (also with e-signature) is considered as successful placement into the study programs.

7.1 Details of the study program fees are listed on the web presence of upskill.study. All fees are accurate at the date published. The fees which are online at the date of the online application apply for the contract.

7.2 All programs consist of a registration fee and a program fee (summer course, semester tuition fees).

7.3 After completing the profile, completing the application and accepting the upskill study programs General Terms and Conditions, the applicant has the option to pay the registration fee.

7.4 The participant is only officially registered with upskill study programs and thus secures a place in a program once the payment of the registration fee has been received.

7.5 The registration fee is not transferable to other persons and does not guarantee that a program (semester/summer course) will take place.

7.6 Any transfer fees from banks or other payment services (e.g. Paypal) are to be borne by the participant.

8.1 If a participants uses upskill.study semester program services, we invoice a program fee (see §7). After the successful placement into a program the participant has to pay the full amount due at least 8 weeks before semester start.

8.2 After completing the online application and accepting the terms and conditions the participant has to pay the registration as set out on our website (herein referred to as first payment). The remaining fee (herein referred to as second payment) has to be paid after the participant has received any kind of program confirmation or contract (also e-mail). The participant will receive an invoice with the program free from upskill.study, which is due 8 weeks before start of each semester or summer course. If the participant has not paid the full fee to the day of departure, the participant will lose his/her place in the study program.

8.3 The registration fee is not considered part of the program fee. After the full amount has been paid, upskill.study will proceed with their services.

If a participant withdraws from the program within 8 weeks cancellation period, upskill.study will stop the placement and delete all personal data . The registration fee is non refundable. Only withdrawals in the form of air mail, fax or email without indicating any reasons are accepted.

10.1 Cancellation

Cancellation 1 to 4 weeks before semester / summer course begin:

• No refund of tuition fee

Cancellation 5 to 8 weeks before semester / summer course begin:

• 50% refund of the tuition fee

Cancellation from 8 weeks before semester / summer course begin:

• 100% refund of the tuition fee

10.2. Withdrawal due to force majeure

10.2.1 upskill.study is not liable for damage or loss (tuition fee) that participants in the study program incur due to unusual or unforeseeable circumstances (force majeure). Upskill.study will endeavor, if Udayana University is willing to partially or fully reimburse tuition fees, to reimburse them to the students.

10.2.2 upskill.study reserves the right, after consultation and goodwill of the partner abroad, to pay a reimbursement of the program fee. The amount of the reimbursement depends on the conditions of the partner company abroad and will be decided on a case-by-case basis.

10.2.3 Program postponement
Until further notice, program participants can change their program 1 date free of charge. If the date changes, participants have 90 days to select a new start date for the program that is later than the original date. If no new date is selected within 90 days, the program will be canceled and there will be no reimbursement of the program fee.

The participant is solely responsible for the visa application and other documents required for entering the country. If the participant is not entitled to receive the visa, is being rejected or does not receive the visa in time, the participant has to bear all additional travel expenses or cancellation fees in case of withdrawal (see §10). It is the responsibility of the participant to carry all necessary documents when traveling abroad.

upskill.study is authorized to terminate the contract on special occasions and without setting a deadline, if the participant is showing inappropriate behavior which has a negative effect on the placement procedure. upskill.study defines a behavior as being inappropriate if the participant does not reply to the emails or withholds information relevant to the placement procedure.

No participant is entitled to receive any payment during the study abroad program.

14.1 Upskills Study Programs has also no liability for any costs such is booking accommodation, organizing visas, flight tickets etc.

14.2 The participant is not entitled to compensation for costs incurred as a result of a course not taking place, e.g. due to force majeure (volcano eruption, airport closure, change in visa conditions) and/or a lack of course participants (min. 8).

14.3 upskill.study has no liability for any lack of services performed by the University of Udayana during the study abroad program. In addition, upskill.study has no liability for any occasions which are not part of their responsibilities (granting scholarships, insurance services etc). Any activities of the participants prior to, during or after their stay abroad are at their own risk.

14.4 upskill.study and its staff are not liable for any damages caused by third party persons. This also applies for traffic accidents, criminal assaults and other life risks caused by the social situation specific for the host country. The participant is obligated to collect sufficient country information prior to the beginning of the program.

14.4 The partners of upskill.study are not obliged to take over liability for any damages caused by the participant during the stay abroad. If the participant violated the code of conduct of the partner organization or upskill.study, the participant cannot change the program. In such cases upskill.study and the University of Udayana are authorized to exclude the participant from any further services.

upskill.study does not provide the student with insurance of any kind. International health insurance, indemnity insurance and accident insurance are mandatory for the whole period of every participant. The participant has to get acquainted with the medical guidelines, vaccinations or other risks associated with the travel to Indonesia.

upskill.study is constantly striving for high performance services. Every feedback helps to improve the service performance. Participants are welcome to hand in a written report (DIN A 4) with pictures and videos. With the effect of 01.04.2014 testimonials will not be rewarded. However, it is within upskill.study discretion to reward a testimonial with 30 USD and to publish the report at their web presences. For this purpose upskill.study has the right to change phrases to a small extent and can edit pictures. The participant agrees to transfer the copyright for text and images to upskill.study.

The regular statutory limitation period shall apply to this contract and the contracting parties. A limitation period of 1 year applies for companies or sales persons.

The participant agrees that upskill.study and its partner organization will forward all personal data (application, resumé etc.) to the University of Udayana during the placement procedure.

There terms are governed by the laws of Singapore. In case the contract lacks of information, all other paragraphs of these terms still apply.
