1. Contracting Parties
1.1 Upskill located in Bali and you are the sole parties to the contract for the provision of your placement services into a study abroad program.
1.2 If the participant is demanding other services which are not part of the mediation service of Upskill education as insurances, vehicle rentals, accommodation, flights, visa etc,, the contract is between the selected service provider and the participant only.
1.3 In some cases the participant will receive an additional contract with from our partner organization, which confirms the successful placement into one of their programs. Our partner and you are the sole parties to the contract/ confirmation. Upskill education is only responsible for the mediation service and errors caused by Upskill education. Liability is precluded for simple negligence. The participant herewith agrees that the partner organization is according to §4 the actual contractual partner for all services provided within the study program itself.
1.4 The participant must have reached the age of 18 by the beginning of the program abroad.
2. Completion of the contract
By clicking on the box besides the phrase ‘I have read and agree to the Upskill education terms and conditions’ the applicant agrees to these terms and conditions. The contract is valid after we have received and confirmed your deposit fee.
Upskill education cannot fully guarantee that the applicant will be placed in the study program as stated in the application. The mediation into an alternative program does not mean that Upskill education is not performing the services as defined in the contract.
3. Object of the contract
The main subjects of this contract are placement services and the current service package of Upskill education at the contracting time. The placement service package can be looked up at the web presence. The services offered may vary according to the countries or specific demands of the applicant.
4.1 The service can be looked up at www.upskill.study. However, Upskill education cannot guarantee that the information online is up to date. The current services of the partner organization apply. The partner organization also reserves the right to change the services included in a program any time without notifying the participants. Upskill education and its partner organizations are not liable for unindebted shifts in program dates.
4.2 Upskill education mediates participants into study programs of third party service providers respectively Udayana University, Bali. Thus, we are only responsible for the mediation service itself, but not for the services performed by the third party partner.
4.3 All program proposals and offers are based on the information of the partner organization or program coordinator abroad. Upskill education is not liable for this information.
4.4 Upskill education has no influence on any factors that may cause a change of program presented on this website. Participants who agree to study abroad and accept the responsibilities and risks that are associated with their travel and stay abroad in the host country in Indonesia.
4.5 If the partner organization does not perform its services as agreed upon in the sub-contract, or the participants decides not to use the services offered by the partner organization and Upskill education understands the reasons why, Upskill education will endeavor to request a refund from the partner organization. However, we cannot guarantee to receive any refund. In addition, we will not start any efforts to request a refund for the participants if the request is irrelevant or not possible due to external policies of other authorities or institutions. The registration fee of Upskill education in no event is refundable when the participant is requesting a refund after the start of the trip.
5. Mediation and placement procedure
Upskill education will start its placement services after the application was successfully submitted online and the receipt of the deposit fee from the participant has been confirmed to the participant.
6.1 The study program confirmation is a separate contract between the participant and the partner organization performing the service abroad.
6.2 This contract has to be signed by the participant and has to be sent to via e-mail.
6.3 The signed study program confirmation (also with e-signature) is considered as successful placement/mediation into one of our programs.
7. Program fees
Details of the study program fees are listed on the web presence of Upskill education. The program fee already covers the placement fee of Upskill education as well as the project fee of the partner organization. All fees are accurate at the date published. The fees which are online at the date of the online application apply for the contract.
8.1 If a participants uses Upskill education mediation services, we invoice a program fee (see §7). After the successful placement into a program the participant has to pay the full amount due.
8.2 After completing the online application and accepting the terms and conditions of Upskill education the participant has to pay the deposit as set out on our website (herein referred to as first payment). The remaining fee (herein referred to as second payment) has to be paid after the participant has received any kind of program confirmation or contract (also e-mail). The participant will receive an invoice with the program free from Upskill education, which is due 14 days after receipt and before start of the journey. If the participant does not meet the due date a fine of 10 Euro is due. If the participant has not paid the full fee to the day of departure, the participant will lose his/her service claim on the partner organization.
8.3 The registration fee is not considered part of the program fee. After the full amount has been paid, Upskill education and its partner organization will proceed with their services.
9. Right of withdrawal
9.1 If a participant withdraws from the program within 14 days cancellation period, Upskill education will stop the placement, delete all personal data and refund the full deposit. Only withdrawals in the form of air mail, fax or email without indicating any reasons are accepted.
9.2 If a participant withdraws from the program at any stage, as Upskill education and its partner organization has already started processing the application with the explicit participant’s affirmation, the deposit will not be refunded.
10. Refund policy
Cancellation before successful program placement
- If the participants withdraws from the program before the contact with the partner organisation has been established, a part of the deposit will be withheld for administrative efforts (administration fee of 50 USD).
- After direct contact between participant and partner organization abroad has been initiated by Upskill education, the participant will not be refunded the registration fee.
Cancellation after successful program placement
- The full program fee is due and will not be refunded.
- In a few exceptional cases Upskill education is authorized to waive part of the program fee.

- The program fee will not be refunded.
- In a few exceptional cases Upskill education is authorized to waive part of the program fee.
- Note: If the participant wishes to shorten the program, the participant has to consult the program coordinator and report to Upskill education. A refund of the remaining fees is not possible.
11. Entry documents
The participant is solely responsible for the visa application and other documents required for entering the country. If the participant is not entitled to receive the visa, is being rejected or does not receive the visa in time, the participant has to bear all additional travel expenses or cancellation fees in case of withdrawal (see §10). It is the responsibility of the participant to carry all necessary documents when traveling abroad.
12.1 Upskill education is authorized to terminate the contract on special occasions and without setting a deadline, if the participant is showing inappropriate behavior which has a negative effect on the placement procedure. Upskill education defines a behavior as being inappropriate if the participant does not reply to the emails or withholds information relevant to the placement procedure. The deposit will not be refunded in this case as allowance for our services
12.2 Upskill education is authorized to terminate the contract prior to a successful placement, if the participant is rejecting 3 program offers. The deposit will not be refunded in this case as allowance for our services.
12.3 Upskill education is authorized to terminate the contract prior to a successful placement, if the participant has been rejected by host university during the placement procedure due to insufficient skill. The registration fee will not be refunded in this case as allowance for our services.
13. Payment/ Remuneration
No participant is entitled to receive any payment during the study abroad program.
14. Deficient program placement
14.1 The participant has to request immediate remedy from the partner organization, if they do not perform the services as mediated by Upskill education. In this case Upskill education is willing to mediate between both parties, even though it is not obligatory. Liability of Upskill education is excluded in this case.
14.2 The participant has to report complaints to the partner organization directly and to Upskill education. Only in this case Upskill education can mediate between both parties. The participant has to grant an appropriate time-frame in agreement with Upskill education, which gives the partner enough time to remedy shortcomings.
15. Liability restrictions
15.1 Upskill education has no liability for any lack of services performed by the partner organization during the study abroad program. In addition, Upskill education has no liability for any occasions which are not part of their responsibilities (granting scholarships, insurance services etc). Any activities of the participants prior to, during or after their stay abroad are at their own risk.
15.2 Upskill education and its staff are not liable for any damages caused by third party persons. This also applies for traffic accidents, criminal assaults and other life risks caused by the social situation specific for the host country. The participant is obligated to collect sufficient country information prior to the beginning of the program.
15.3 The partner of Upskill education are not obliged to take over liabilty for any damages caused by the participant during the stay abroad. If the participant violated the code of conduct of the partner organization or Upskill education, the participant cannot change the program. In such cases Upskill education and its partner organizations are authorized to exclude the participant from any further services.
Upskill education does not provide the student with insurance of any kind. International health insurance, indemnity insurance and accident insurance are mandatory for the whole period of every participant. The participant has to get acquainted with the medical guidelines, vaccinations or other risks associated with the travel to the host country.
Upskill education is constantly striving for high performance services. Every feedback helps to improve the service performance. Participants are welcome to hand in a written report (DIN A 4) with pictures and videos. With the effect of 01.04.2014 testimonials will not be rewarded. However, it is within Upskill education discretion to reward a testimonial with 30 USD and to publish the report at their web presences. For this purpose Upskill education has to right to change phrases to a small extent and can edit pictures. The participant agrees to transfer the copyright for text and images to Upskill education.
The regular statutory limitation period shall apply to this contract and the contracting parties. A limitation period of 1 year applies for companies or sales persons.
19. Personal data
The participant agrees that Upskill education and its partner organization will forward all personal data (application, resumé etc.) to host companies during the placement procedure.
20. Governing Law
There terms are governed by the laws of Singapore. In case the contract lacks of information, all other paragraphs of these terms still apply.

Thus, the following description outlines the personal information we receive and collect from you when you use our placement/mediation services. We want to make clear, what information we collect, how we collect it and for what we use or don’t use it.
Information about you
As an international placement agency for study abroad programs, we may collect and save non-public, personal information directly from our applicants/ participants.
With “information about you” we refer to personal information we save when you use our online registration based services. This includes personal information such as name, contact details, CV, motivational letter, picture, travel preferences, profession or education and flight details.
Upskill education.com collects personal information when you register online for one of our services such as:

- Subscribe to our Email newsletter
- Book our placement service for a program of your demands
Upskill education Customer Information System
Upskill education.com offers an online Customer Information System to all users, to provide a platform for all data relevant for the placement in one of the programmes. Users can save and administrate travel preferences, CV, motivational letter and personal information. In addition, all users can contact Upskill education.
Upskill education also uses intranet functions to provide an organized registration process and to collect, administrate and monitor personal information from all users, who made use of registration based services.
Our use of your personal information
(1) For the purpose of providing you with our services, including insurance, accommodation arrangements etc., we may disclose and process your information outside Indonesia.
(2) If we do receive your personal information, we will only use it for the purposes described where it is collected, and we will not sell, license, transmit or disclose this information outside of Upskill education.com unless
- you expressly authorize us to do so
- it is necessary to allow our partner organizations or agents to provide services for us
- in order to provide our services to you (and contacting you where necessary)
- it is disclosed to entities that perform marketing services on our behalf or to other entities with whom we have joint marketing agreements
- it is necessary in connection with other business purposes including, without limitation, customer care, service quality, business management and operation, risk assessment, security, fraud and crime prevention/detection, monitoring, research and analysis, marketing, market trends, dispute resolution, credit checking, or
- otherwise as we are required or permitted by law.
If you do not agree to Our Use of Your Information above, we cannot engage/do business with you or accept your order for a placement in one of our programmes offered.
We may from time to time contact you with information on offers of programmes and services, brochures, new programmes, forthcoming events or competitions. We will tailor the information we send you unless you tell us not to.
We appreciate your questions and comments about our company and services and welcome your email messages to mailboxes listed on our website or messages via myKIS. We will share your messages with those within our organization who are most capable of addressing the issues contained in your message. We will keep a copy of your message until we have had an opportunity to address your concerns. We may archive your message for a certain period of time or discard it once it is no longer needed.
You have the right to ask in writing not to receive direct marketing material from us. If available, you can amend your previous preference on our website(s) or you can write us to unsubscribe email. Once properly notified by you, we will take steps to stop using your information in this way. Please allow us a reasonable period of time in order to satisfy your request.
To ensure that we carry out your instructions accurately and improve our service we may review, monitor and/or record: telephone calls, web traffic, activities, etc. and social media. All recordings and derivative materials are and shall remain our sole property.
